The property description for a property I recently previewed stated, "Pool-sized yard." Yet when I went to see the home there was nothing I could see that an inground pool (traditionally built in Texas - not even an inground play pool) could fit inside this size lot because the covered patio took up most of the yard. Unless a buyer wanted a kitty pool to dip toes into a tiny blow up tub or child's pool with no depth, it wasn't going to happen unless the new buyer ripped out the covered patio and started from scratch. Marcus Aurelius was pure genius - "Everything we hear is an opinion, not a fact. Everything we see is a perspective, not the truth." But.... members of the National Association of REALTORS® are obligated to follow the Code of Ethics. 

 

NAR'S CODE OF ETHICS - DUTIES TO CLIENTS & CUSTOMERS 

Article One:

REALTOR® protect and promote their client's interests while treating all parties honestly.

Article Two: 

REALTORS® refrain from exaggeration, misrepresentation, or concealment of pertinent facts. 

Article Twelve:

REALTORS® are honest and truthful in their communications and present a true picture advertising, marketing, and in other public representations.

There are objective facts like measurements. Those are a form of communication.  What this person did is not pay attention to those facts..  When one talks about pools, they should in an ideal situation know what the requirements for a pool are in terms of size, etc.  What you described is common in all professions...

Like how big a selling factor is it in that neighborhood? What we see around here a lot is "gulf view".  Not really. Through the trees... through buildings.... leaning off the balcony.

Wendy Rulnick - this specific subdivision and HOA has restrictions for size pool. Knowing this information and looking at the survey encroachments easments, without tearing out the patio, a pool would be impossible. We don't have gulf views in this area.

Hi Patricia... puffery has sadly been a staple of the real estate industry for decades. I see homes represented all the time as something that they are not quite that. Very annoying. I don't even see that as a perspective issue... it's just plain old exaggeration.

Patricia, weeeellllll like the quote says "everything we see is a perspective, and not the truth", and a kitty pool is a pool.  This was the perspective of a very optimistic Realtor ....... LOL

Wanda Kubat-Nerdin - Wanda Can! - you're like a wizard who can predict with precise accuracy - LOL! The property description included that the kitchen and the bath had a complete overhaul. The truth is the two rooms that need a complete overhaul the most were the kitchen and the bath off the primary bedroom. I have pictures to proof it! Oh, and by the way, in this hot seller's market, it has been on the market the longest with no contracts. Can you believe it?

Myrl Jeffcoat - I once had a buyer who started out looking at all those primo properties on day one. I don't know if she ever slept! When she had exhausted her search, she finally asked me to only send her listings for ugly houses and she was especially interested in seeing the ones with terrible pictures in the MLS. There really wasn't much to see but as soon as we went to see one on the market that had been active for more than 100 days and the photos looked absolutely horrible we went. She saw. She bought it!!! Without stress or any competition from other buyers, she made a heck of a deal and the property sold without a hitch. She was so happy and proud of herself for not giving up and to try something different.

Nina Hollander, Broker It's a pity when that happens and a disservice to the seller. Plus, it's a waste of time to buyers and their agents. Good to great agents want to get their listings old quickly and not be content to have their sign in the yard and to feel pride that they have one listing. Time is of the essence in all aspects of a listing and/or transaction.
