Strategies to win a bidding war

Right now pre-owned home inventory for active listings is at historically low levels causing housing frenzy spikes. Inventory challenges equal competition for homes that are desirable and priced appropriately. To help buyers put their best foot forward on the next home offer here are a few strategies for winning a bidding war in today's market. 

Offer a seller post-occupancy / rent back agreement

Buyers I represented recently won a multi-offer situation by offering a 30 day  post-occupancy with a 30 day option to extend to sellers who were having a new home built. Most lenders will allow a buyer to offer a 30 to 60 day rent back agreement to the current owner of the property. This type of arrangement gives the sellers more time to find a property, have a house built , pack, or finish out the school year. The buyers who have the luxury of being flexible, a post-occupancy can easily make an offer very appealing to the sellers. 

Get pre-approved

The first step in the home buying process is to get pre-approved from a well regarded local lender. This is critical as the final decision in a multi-offer situation could come down to who the listing agent knows and can trust to get the loan across the finish line. Also look for a lender who can recommend the right loan program. I recently had a buyer client who qualified for a $10,000 closing cost grant program which allowed them to make a stronger offer to secure the deal. Having an experienced loan officer who can recommend the right loan program might make the difference in making a winning bid.

Pay cash or make a large down payment

In 2022 Frederick, Md. was the number one place in the country for cash deals. Paying cash is still king, but be prepared to show the proof of funds from your financial advisor. I submitted quite a few cash offers for buyer clients last year. If cash is not an option a 20% down payment with a strong lender pre-approval may help win a bidding war also.

Offer compelling terms

Over my career as a REALTOR® I can honestly say rarely is the decision made to accept an offer solely on price alone. Sellers typically make their decision after weighing several factors with the terms of the sale being extremely important. In Maryland the State and local transfer taxes per the contract are split 50/50 between buyer & seller. A buyer could offer to pay the 100% of the transfer taxes to add to the seller's bottom line. While I would never recommend any buyer to waive a home inspection a pre-offer inspection maybe able to be preformed with the permission of the sellers. Waiving an appraisal or adding an appraisal gap clause may also significantly strengthen a buyer's offer in the eyes of a seller.

Find the right REALTOR®

It is critical to find an agent who has a great reputation in the real estate community and one who networks with other REALTORS® in the local market place. Prior to submitting an offer a good buyers agent will call the listing agent to ask what is most important to the seller. There are many times I have represented buyers where my relationship with the listing agent made the difference. If the Seller's agent has confidence you will get the deal across the finish line that is worth it's weight in gold.

I recently won a bidding war because I structured the offer with minimal inspections and used an escalation clause. The other offer had an escalation clause matching mine but had more inspections, so my bid was better. PLUS, my reputation and association with the listing agent made it an even better choice because he trusts me to work professionally. It all counts when it is all said and done!

Brian England it is not fun getting too many offers and having to deliver sad news to so many. I like to try and present offers as quickly as possible and not wait too long, as many of the offers start to look alike and then it is a tough decision for the sellers.

I had a buyer recently that was presented with terms the seller wanted.  Post settlement occupancy was one of them.  The buyer refused.  They had relocated from out of state and wanted to start their new life NOW.  I tried to talk to him about how that one term could mean the difference between knowing where he was going to live or continuing to house hunt.  Needless to say, we lost and are still out house hunting.  We are now nearing the point where the post settlement occupancy would have been over as well.

These are all great tips, with having a strong pre-approval with a reputable lender and working with the right agent such as yourself at the top of the list. Reaching out to the listing agent early on to find out what the seller is looking for (closing date, terms, rent-back period, etc.) can help especially if you can build some rapport and show what kind of communicator you are.

In my area, Silicon Valley homes are always a bidding war. The buyers have very good idea and often do not even walk into an overpriced home.

I advise my buyers to take their best shot...like 'highest and best'...right from the beginning. Sure, rent-backs can be important, but in the end, if the other bidders can and do offer better price/terms there is nothing you can do about it.

Some very good ideas here especially contacting the listing agent to find the sellers motivation and mind set.  I am not sure if bidding wars are entirely over but this is a great skill going forward.  Experience and knowledge does matter.

I was in a bidding war this weekend and the listing agent pushed for no inspections, and appraisal waiver, making it sound like he had several offers.  I doubt he did--it's just brutal out there sometimes, buyers have to have a strong constitution

These are all great tips and this was a great post. My market is filled with exceptions to what you find in the rest of the nation- so I have a bunch of guidance for my buyers that wouldn't apply here. For example- I tell my clients to have an attorney selected prior to submitting an offer. This tells the listing agent that you are ready to move forward immediately and are serious about the process. While the buyer would eventually need to select an attorney- having one selected in advance is an easy way to strengthen an offer without spending any additional money. Another tip I have is to have the buyers REBNY Financials (REBNY is NYC's home grown NAR alternative) which is prepared and reviewed by me well in advance of an offer. The REBNY Financials is part income statement, part balance sheet. When a buyer is considering a co-op (or even a condo- but it's not as vital in most cases), I am going to review their financials to see if there are ways I can strengthen their financial presentation to the listing agent. It's common that buyers don't really understand how to do this (or for that matter, lots of agents don't know how to do this either- and this also makes a difference in trying to win a bidding war) - and because a co-op board can reject buyers, it's vital that we always put our best foot forward. These are just a couple of examples that are unique to my market on how to win a bidding war in NYC.
